On August 29, the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Army Corps) issued a final rule amending the 2023 definition “Waters of the U.S.” (WOTUS) to conform with the U.S. Supreme Court’s (SCOTUS) decision in Sackett v. EPA. The amendments made by the EPA and the Army Corps (the agencies) remove or elements of the definition that are invalid under the Sackett decision, including the significant nexus test and the definition of ‘adjacent.’ Join NACo for a discussion of the amendments made by the agencies and the future of WOTUS.

Gulf counties receive more than $92 million in revenue sharing from offshore energy projects
On March 27, the U.S. Department of the Interior (DOI) announced hundreds of millions of dollars in revenue sharing from Gulf energy projects, including more than $92 million which will be distributed directly to 42 coastal counties and parishes and Texas, Louisiana, Alabama and Mississippi. The revenue is generated from offshore oil and gas projects on the federally managed Gulf Outer Continental Shelf, and a portion is redirected to states and counties.

On February 23, the U.S. Department of the Interior (DOI) announced a final rule updating the Department’s regulations for implementing the National Environmental Policy Act (NEPA; P.L. 91-190). In a step forward for counties, the final rule reinstates provisions that name local government agencies as cooperating agencies during the NEPA environmental review process.
