In state legislative chambers and governors’ offices across the U.S., interest in local affordable housing issues is on the rise. The contexts are unique to each state and region, but the common thread is a multi-dimensional housing crisis that shows few signs of abating. State legislation that deals with housing spans dozens of policy areas, many of which are interconnected. This study, prepared for NACo by Ben Kelly, looks at a few of them, including a mix of supply-side and demand-side topics.

Lawmakers reintroduce the Build Housing with Care Act
On January 30, Senator Ron Wyden and Congresswoman Bonamici reintroduced the Build Housing with Care Act. This legislation would establish a new competitive grant program under HUD intended to boost the supply of co-located child care facilities and affordable housing developments.

HUD withdraws proposed Affirmatively Furthering Fair Housing rule
On January 16, 2025 the U.S. Department of Housing and Urban Development (HUD) published in the Federal Register a withdrawal of a proposed affirmatively furthering fair housing (AFFH) rule from February 2023. The 2023 proposed rule incorporated much of the framework of a 2015 AFFH rule and would have required program participants to submit an equity plan to HUD every five years.
