During the 2018 budget cycle, the Washtenaw County Treasurer partnered with the Washtenaw County Probate Judge to provide targeted assistance to families living in inherited homes where legal title has not been transferred. The Board of Commissioners approved their Strategic Investment budget request. Families targeted for this program are unable to afford legal assistance to untangle property ownership and probate the estate. Many are located in areas that have been historically marginalized, during times of racial segregation and discriminatory lending. Establishing legal ownership in property allows homeowners to access tax code entitlements and other services, including property tax credits and exemptions, state and federal income tax credits, and weatherization and energy assistance programs. Acquiring legal ownership also allows families to realize equity in their property with a conventional mortgage or sale. Furthermore, an analysis shows that most of the properties are owned free and clear and can become very sustainable, affordable housing.Pro-bono attorneys and mediators worked the cases; the court waived fees; and the Washtenaw Legal News waived publication fees. Now families and attorneys are requesting to join the program. For a total cost of $1,012, nearly a $1 million in property wealth was transferred to families.
